GENERAL TERMS AND CONDITIONS OF USE

GROUPE COMPAGNIE HOTELIERE DE BAGATELLE LOYALTY PROGRAMME

1- PURPOSE AND CHARACTERISTICS

 

These General Terms and Conditions of Use ("T&Cs") govern the loyalty programme set up by COLLECTION BAGATEL, a single-shareholder simplified joint-stock company, registered with the Paris Trade and Companies Register under Number 794 053 264, whose registered address is located at 8, rue Christophe Colomb in Paris (75008) (hereinafter "Groupe COMPAGNIE HOTELIERE DE BAGATELLE"), for the benefit of their clients of 15 June 2018, in partnership with HOTELAPPZ (the "Programme").

 

By accepting these T&Cs, customers of the COMPAGNIE HOTELIERE DE BAGATELLE Group become members of the Programme,  ("Member" or "Members").

 

By joining the Programme, each Member can enjoy advantages and/or rewards, gained through a points system ("Loyalty Points") credited to an account  ("Account"), in accordance with the conditions described in the present T&Cs.

 

The Programme is made available in digital format only. No card or physical medium is provided to Members.

 

Use of Loyalty points gained through the Programme is subject to compliance with all the terms and conditions of these T&Cs.

 

The present T&Cs may be added to or modified at any time by the COMPAGNIE HOTELIERE DE BAGATELLE Group, as may the rules governing the accumulation and use of Loyalty Points. Under no circumstances will any modification to the programme or these T&Cs give rise to any right to seek compensation. An email will be sent to each Member in the event of modification to the T&Cs.

 

The Programme operates in the following COMPAGNIE HOTELIERE DE BAGATELLE Group hotels: LES PLUMES HOTEL, VICE VERSA HOTEL, HOTEL LES THEATRES, PLATINE HOTEL,  THE CHESS HOTEL, LE ROCH HOTEL&SPA ("Hotels" or "Hotel").

 

SIf one of the Hotels leaves the COMPAGNIE HOTELIERE DE BAGATELLE Group, the Programme will no longer apply in that Hotel. As a result, i) loyalty points will not be earned through bookings made with that Hotel and ii) Loyalty Points may not be used in that Hotel.  Loyalty Points earned by Members are valid for use in other  COMPAGNIE HOTELIERE DE BAGATELLE Group hotels. The COMPAGNIE HOTELIERE DE BAGATELLE Group will inform its members as soon as possible.

 

 

 

2- ELIGIBILITY FOR MEMBERSHIP OF THE PROGRAMME

 

Registration for the Programme is free of charge and voluntary. All natural persons of age, with the capacity to enter into a contract, may join the Programme and become Members.

 

The following registration methods are available:

  • on the COMPAGNIE HOTELIERE DE BAGATELLE Group website via the Loyalty Programme section. After entering their surname and first name, email address and country, Members will receive a confirmation email to complete the registration process; 

  • on the website of each Hotel via the Loyalty Programme section. After entering their surname and first name, email address and country, Members will receive a confirmation email to complete the registration process; 

  • at the reception of each Hotel on request;

  • upon receipt of an email from the COMPAGNIE HOTELIERE DE BAGATELLE Group with a link to the loyalty Programme section of the Hotel and/or  COMPAGNIE HOTELIERE DE BAGATELLE.website;

 

When joining the programme, the future Member is required to familiarise themselves with the present T&Cs.  By checking the box "I hereby join the Compagnie Hôtelière de Bagatelle loyalty programme and I acknowledge that I am fully familiar with and agree to abide by the General Terms and Conditions of Use applicable to the loyalty programme" on the website, when joining online, or by ticking the corresponding box when joining at a Hotel, each Member is deemed to have accepted these T&Cs without limitation or reservation.

 

A membership confirmation email will be sent automatically to the Member in order to provide him/her with a membership number.

 

In order to join the Programme, the Member must hold a valid email address. By joining the Programme, the Member agrees to receive informatve emails from the COMPAGNIE HOTELIERE DE BAGATELLE Group, on the operation of the Programme, and any changes to it. Should the Member write to the COMPAGNIE HOTELIERE DE BAGATELLE group  indicating that they no longer wish to receive such emails, registration with the Programme will be terminated. Any loyalty points earned will no longer be available and will be lost.

 

3- EARNING LOYALTY POINTS

 

Members earn Loyalty Points on their account, after spending and paying for one night's stay or more in one of the Hotels, in accordance with the conditions described below.

 

From the time they join the Programme, Loyalty Points will be credited to the Member staying at a Hotel and registered as the booking holder, where the booking holder and the person staying are the same person. If the person registered as the booking holder is not the person staying at the hotel, only the booking holder will earn Loyalty Points. For group bookings, the booking holder will receive all the Loyalty Points.

 

Loyalty Points may only be gained after the customer confirms registration with the Programme. The acquisition of Loyalty Points cannot be retroactive and apply to the night stays paid and consumed before the Programme Member joins.

 

Valid booking channels for the Programme and excluded channels:

The number of Loyalty Points earned depends on which booking channel is used:

 

  • Two loyalty points per euro spent (incl. all taxes and charges) are awarded for night stays booked through the COMPAGNIE HOTELIERE DE BAGATELLE Group distribution channel (GROUPE COMPAGNIE HOTELIERE DE BAGATELLE website, Hotel website, telephone or email at the Hotel, at reception)

 

  • One loyalty point per euro spent (incl. all taxes and charges) is awarded for all other channels (particularly, OTA (Online Tourism Agency), contracts negotiated for business travel, group and travel agent bookings), with the exception of the exclusions in the paragraph below.

 

  • Night stays booked through the Hotusa, Hotelbeds, Mr & Mrs Smith agencies, tour operators (specifically JTB, Travel Impressions, Harrison Maxwell, Southern Cross, AC Tours, Avanti, FTI, Frantour, DER Tour, TUI, Intertourisme, Transeurope, Kuoni) and wholesalers (specifically Amoma, Hotel Quickly, Destinia, Hotels Click, Hotel Info, Zen Hotels) are not eligible for the loyalty programme and Loyalty Points will not be awarded for such stays.

     

When the amount spent includes euro cents, it is rounded down to the euro to calculate the Loyalty Points acquired.

 

Night stays booked for Hôtel LE ROCH HOTEL&SPA through the Starwood Hotels website or the Starwood Preferred Guest ("SPG") loyalty programme or any other channel through which SPG loyalty points are accumulated, are not eligible for the Programme under these T&Cs. In other words, when a member is awarded points for the SPG loyalty programme for a night at the LE ROCH HOTEL&SPA, that member cannot be awarded points under the COMPAGNIE HOTELIERE DE BAGATELLE Group Loyalty Programme. For the purposes of management of the Programme, Loyalty Points may be credited and removed consecutively.

 

Rates at which the Programme applies:

Loyalty points can be awarded in respect of all rates for night stays displayed by one of the booking channels that are eligible for the Programme.

 

Expenses included in the Programme and excluded expenses:

Loyalty Points may only be earned in respect of the price of the night stay ("Accommodation Costs").  Expenses for additional services [specifically: spa, restaurant, minibar, dry cleaning, bar, breakfast, tips, taxi trips booked by the Hotel reception or any other external booking completed by the Hotel reception ("Ancillary expenses") incurred during a stay do not qualify for the award of Loyalty Points.

 

Loyalty points are awarded upon leaving the Hotel ("Check-out") when the bill for the stay has been paid in full, confirmed and received by the COMPAGNIE HOTELIERE DE BAGATELLE Group.

 

In the event of a dispute concerning the amount of the booking after payment and Check-out, the amount of the Loyalty Points acquired will be readjusted in accordance with the price actually paid.

 

Members may also acquire Loyalty Points through promotional offers.

 

4- VALIDITY AND CONSULTATION OF LOYALTY POINTS

 

Loyalty Points (including bonus Loyalty Points) acquired by a Member are valid for two years as of the time they are awarded. Loyalty Points acquired and not used by the end of the validity period will automatically become unavailable and will be lost.

 

Members will be informed periodically, through the receipt of a quarterly email, of the status of their Account, i.e. the number of Loyalty Points acquired and valid and their period of validity.

 

Members may also check the status of the Account at the reception of each Hotel, by written request through the "CONTACT" section of the COMPAGNIE HOTELIERE DE BAGATELLE Group website, by email to contact@cie-bagatelle.com, by letter to COMPAGNIE HOTELIERE DE BAGATELLE 8 rue Christophe Colomb 75008 Paris.

 

The calculation of Loyalty Points as drawn up by the COMPAGNIE HOTELIERE DE BAGATELLE shall alone be valid. Claims may be made under the conditions set out in the Article on 6-CLAIMS".

 

5- USE OF LOYALTY POINTS

 

Loyalty Points awarded may be used in all Hotels. Rewards  ("Reward" or "Rewards") are given in return, under the conditions descibed in this article. The rewards may be used for night stays booked through the COMPAGNIE HOTELIERE DE BAGATELLE Group distribution channel (COMPAGNIE HOTELIERE DE BAGATELLE Group website, Hotel telephone or email, directly at the Hotel reception) or for group prices for companies in the context of business trips, regardless of the booking channel.

 

The Member is required i) to inform the COMPAGNIE HOTELIERE DE BAGATELLE Group of their wish to use the Loyalty Points to obtain a reward at the reception of the Hotel where they are staying and ii) to sign the appropriate form at the Hotel reception. As of the signature, the Loyalty Points used are deducted from the Account. A confirmation email is sent automatically to the Member upon use of Loyalty Points.

 

Loyalty Points collected at earlier dates are used first. Loyalty Points are non-transferable. Loyalty Points cannot be assigned or exchanged for cash.

 

Any awards to which a Member is entitled, detailed in the table below, depend on the number of Loyalty Points acquired and used. Awards are displayed in the Hotels eligible for the Programme..

A minimum of 400 points is needed to obtain a reward. ("Breakfast" reward at a hotel, excluding the ROCH HOTEL&SPA).

 

The rewards chosen by the Member may be used between check-in and check-out.

 

Specifics of accommodation reductions, breakfast reductions and restaurant reductions for  the ROCH HOTEL&SPA

 

Reductions of €50 and €100 ("Accommodation Vouchers") may only be used to pay Accommodation Prices (excluding Ancillary Expenses) booked at the flexible rate (possibility to cancel and obtain a refund).

 

The breakfast reductions are only used during a stay booked with a breakfast fee not included (room only).

 

The upgrade applies for one night and for upgrades to the class immediately above (with the exception of the Bien-être and Saint-Roch Suites at LE ROCH HOTEL&SPA).

 

The reductions of €50 for the Hotel LE ROCH HOTEL&SPA ("Roch Restaurant Vouchers") cannot be used for the breakfast meals or special events. 

 

The Accommodation Vouchers and Roch Restaurant Vouchers may be used throughout the stay between check-in and check-out. They are for fixed amounts, and may not be spread across two stays.

 

The Accommodation Vouchers may not be adjusted to the price of the actual Accommodation Costs paid by the Member. No refunds will be given where the amount of the Accommodation Voucher chosen by a Member exceeds the Accommodation Price of the booking.

 

Roch Restaurant Vouchers will not be adjusted to the actual restaurant expense paid by the Member. No refunds will be given where the amount of the Roch Restaurant Voucher chosen by a Member exceeds the restaurant spend during their stay.

 

The COMPAGNIE HOTELIERE DE BAGATELLE Group reserves the right to modify the Rewards below, and no compensation and/or Rewards or advantages shall be due to the Programme Member.

 

6- CLAIMS

 

Any claims in respect of the Programme may be made in writing via the "CONTACT" tab of the COMPAGNIE HOTELIERE BAGATELLE Group website or the website of each hotel, by email to contact@cie-bagatelle.com or by post to COMPAGNIE HOTELIERE DE BAGATELLE 8 rue Christophe Colomb 75008 Paris.

 

Any claims concerning a Member's Account balance should be addressed to the COMPAGNIE HOTELIERE DE BAGATELLE Group, within five years as of the date on which the Member became aware or should have become aware of any errors on the account balance.

 

If the claim is found to be justified, upon examination, the Member's account will be credited with the missing Loyalty Points, as applicable.

 

In the event of a dispute between a Member and the COMPAGNIE HOTELIERE DE BAGATELLE Group regarding these T&Cs or the Programme, the Member may refer the issue to the MEDYCIS mediator online on  https://www.medicys.fr/.

 

7- TERM AND TERMINATION OF MEMBERSHIP

 

The term of membership is indeterminate.

 

Membership may be terminated:

 

  • at any time on the request of the Member, in writing via the "CONTACT" tab of the COMPAGNIE HOTELIERE BAGATELLE Group website or the website of each hotel, by email to  contact@cie-bagatelle.com or by post to COMPAGNIE HOTELIERE DE BAGATELLE 8 rue Christophe Colomb 75008 Paris. Once the request from the Member by the COMPAGNIE HOTELIERE DE BAGATELLE Group, the Loyalty Points earned will become unavailable and will be entirely lost.

 

  • on the initiative of the COMPAGNIE HOTELIERE DE BAGATELLE Group, in the event of non-compliance with the present T&Cs or a fault committed by a Member during their stay in one of the Hotels. Any loyalty points earned will no longer be available and will be lost.

 

The COMPAGNIE HOTELIERE DE BAGATELLE Group also reserves the right to bring the Programme to an end for the future and for all the Members. If the Programme is brought to an end, each Member will be given advance notice by email. Members who have left the Programme may not rejoin and will not be in a position to earn new points. However, the points earned by each Member once the Programme has been terminated will remain valid for one month.

 

8- PERSONAL DATA

 

In accordance with Law n°78-017 of 6 January 1978 (as amended) on information technology, files and freedoms (the French Data Protection Act), the data required to register for the Programme are marked with an asterisk on the registration form. Membership will not be granted unless all the information marked with an asterisk is provided.

 

The information collected on the registration form is processed and registered in an online file hosted by HOTELAPPZ for COLLECTION BAGATEL and its subsidiaries.

 

The data controller is COLLECTION BAGATEL, a single shareholder simplified joint-stock company registered with the Paris Trade and Companies Register under Number 794 053 264, with address at 8, rue Christophe Colomb à Paris (75008), represented by its current President, BIM, a simplified joint-stock company, registered at the Paris Trade and Companies Register, under number 487 719 288, with registered address at 54 avenue Marceau 75008 Paris, which is in turn represented by Gilles Gojan, its Managing Director.

 

Data collected via the registration form are used for the purposes of managing the Member's Account, keeping the Member informed on issues concerning their Membership of the programme and drawing up statistics and market analysis.

 

The Member's information will be kept for the entire duration of the Programme and archived for the applicable period under law.

 

Member may check and access their personal data in accordance with Article 39 of Law  n°78-017 of 6 January 1978 (as amended) and may seek rectification thereof in accordance with Article 40 of Law n°78-017 of 6 January 1978 (as amended), by written request through the "CONTACT" tab of the COMPAGNIE HOTELIERE DE BAGATELLE website, by email to contact@cie-bagatelle.com or by post to COMPAGNIE HOTELIERE DE BAGATELLE 8 rue Christophe Colomb 75008 Paris. Members may also contest such data on legitimate grounds under the conditions provided for in Article 38 of Law n°78-017 of 6 January 1978 (as amended).

 

Each Member is entitled to give instructions as to what is to be done with their personal data after their death, in accordance with Article 40-1 of Law n°78-017 of 6 January 1978 (as amended).

 

In the event of a change in contact details, name or any information provided under the registration form, the Member is required to inform the COMPAGNIE  HOTELIERE DE BAGATELLE Group in writing via the "CONTACT" tab of the website for the COMPAGNIE HOTELIERE BAGATELLE Group, by address to contact@cie-bagatelle.com or by letter to COMPAGNIE HOTELIERE DE BAGATELLE 8 rue Christophe Colomb 75008 Paris.

 

The COMPAGNIE HOTELIERE DE BAGATELLE may not be held liable should the Member fail to abide by this obligation. Each Member is responsible for the accuracy of the information provided.

 

8- APPLICABLE LAW

These T&Cs are governed by French law.
